A court dictates prison for soccer player Lucas Hernández for skipping his partner's restraining order

A Madrid court has ordered the imprisonment of French footballer Lucas Hernández, a Bayern Munich player and trained in the Atlético de Madrid youth academy, for being a repeat offender in crimes related to sexist violence, as reported in a press release the Superior Court of Justice of Madrid (TSJM). The footballer had requested the suspension of the sentence issued in 2019, which decreed his entry into prison for skipping the restraining order of his partner, but the court has rejected it. The events go back to 2017, when he went on a trip with his partner despite the distance order of 500 meters.

Hernández was sentenced to six months in prison for breaking the estrangement on his sentimental partner four years ago, with whom he went on a honeymoon despite the fact that both had separate measures of distancing themselves from the other for a conviction prior for crimes of mistreatment in the family environment. The arrest occurred in June 2017 after landing at terminal T-4 of the Madrid Barajas airport, coming from the Bahamas. The woman was identified but not detained, according to the newspaper AS , as the court had not yet notified her of the restraining order.

Both They decided to resume their relationship after a strong argument that they had in February of that year and that led to the arrest of the player, then Atlético de Madrid, after a fight with his girlfriend. The two were sentenced to 31 days of work for the benefit of the community as perpetrators of a crime of mistreatment in the family environment.

The player was detained at passport control and remained in the cells of the Madrid airport, until he was transferred to the Violence Against Women Court number 3 in Madrid. The magistrate released the player after taking a statement.

In 2019 the sentence was handed down, condemning Hernández to half a year in prison as the responsible perpetrator of a crime of breach of sentence of article 468. 2 of the Penal Code. This Wednesday, the Criminal Court No. 32 of Madrid has denied the suspension that the player had requested and has required that the 19 of October, go to the court to be transferred to the request for voluntary admission to prison of the player of 25 years, within the non-extendable period of 10 days counting from that moment. The TSJM informs that the execution of the sentence has been appealed before the Provincial Court of Madrid.

“The Criminal Court of enforcement understands that in this case the legal requirements to grant Lucas Françoise BH the benefit of the suspension of the sentence, since he is not a primary offender, since there is a firm sentence, dated 21 – 3- 2017, of the Criminal Court No. 35 of Madrid for the crime of injuries in the field of gender violence and another sentence, also firm, also for a crime of injuries in the field of gender violence, of the Criminal Court No. 5 of Móstoles “, adds the Superior Court of Justice of Madrid in its press release.

Hernández signed for the German team in the summer of 2019 for about 80 million euros. According to the newspaper AS, Bayern Munich had no knowledge of this cause. He also plays for the French national team, with which he won the World Cup in Russia in 2018 and the Nations Cup last Sunday.
